i want to sell the silver jewelry at flea markets. It is pretty, it does not have any insignia and it is silver.
Legal would imply that the designer is unable to launch a suit and win.
Now that would require a test case in court to determine whether the designer can take all of your profits and some punitive damages.
If the product is a very close copy, it is likely that the designer can and will sue, and win.
926 has no meaning to me; if it is important, study tort law.
